Privacy Policy

1. Introduction

This Privacy Policy explains how Eightball, Inc. (“Eightball,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information in connection with Eightball Teams, our training, testing, and certification platform for organizations, and its related websites, applications, and integrations (the “Service”).

Capitalized terms not defined here have the meanings given in our Terms of Service. This policy does not apply to the Eightball consumer study app, which has its own privacy policy.

2. Our Role

The Service is provided to organizations (“Customers”), usually employers, which invite their staff and others (“Users”) to use it. For personal information that a Customer or its Users put into the Service, such as uploaded material, answers, results, and recordings (“Customer Data”), the Customer decides how it is used and is the controller (or “business”). We process Customer Data on the Customer’s behalf and under its instructions. If you use the Service through your employer or another organization, its own privacy notice governs its use of your information, and you should direct privacy questions and requests about Customer Data to that organization.

We are the controller of information we collect for our own purposes, such as visits to our websites, sales and support communications, billing contacts, and information we use to secure and improve the Service.

3. Information We Collect

Account information. When you sign in with Google, Microsoft, Zoho, or another identity provider, we receive your name, email address, profile image, and related identifiers from that provider. We also record your organization membership, role, and settings such as language preference.

Content. Documents, files, and other material that Customers upload to build training and certifications, and the lessons, exams, and other content the Service generates from them.

Learning activity. Assignments, answers, scores, grades, attempts, progress, time spent, skipped or completed steps, certifications earned, and feedback.

Chat, voice, and role-play. Messages you send to AI assistants, and audio, transcripts, and evaluations from voice exercises, spoken answers, and role-plays. Voice features use your microphone only after you grant permission in your browser.

Integrations. If a Customer connects the Service to other tools, such as a messaging workspace or an AI assistant, we receive the information needed to run that integration, such as workspace and user identifiers and access tokens.

Communications and billing. Information you give us when you book a demo, contact support, or correspond with us, and billing contact and payment details for Customer accounts, which are handled by our payment processors.

Device and usage information. IP address, browser and device type, operating system, pages and features used, referring pages, timestamps, errors, and similar log and diagnostic data, collected through cookies and similar technologies.

4. How We Use Information

We use personal information to:

  • provide, operate, and maintain the Service, including authenticating users;
  • generate training content, exams, grades, feedback, and assistant responses, and show results and progress to the appropriate people in a Customer’s organization;
  • send service messages such as invitations, assignments, reminders, and notices;
  • provide customer support and respond to requests;
  • process billing and manage Customer accounts;
  • monitor, debug, secure, and improve the Service, and detect and prevent fraud, abuse, and security incidents;
  • communicate with business contacts about the Service, subject to their right to opt out of marketing; and
  • comply with law and enforce our agreements.

We do not sell personal information, and we do not share it for cross-context behavioral advertising.

5. AI Processing

Many features of the Service rely on artificial intelligence. To produce AI output, content, messages, answers, and audio are sent to AI model providers that process them on our behalf. AI output may be inaccurate, and grades or evaluations it produces may be reviewed or changed by the Customer. Customers decide how results produced by the Service are used, including any decision about an individual.

6. What Your Organization Can See

If you use the Service as a member of a Customer’s organization, managers, administrators, authors, and collaborators in that organization may be able to see your name, email, assignments, answers, scores, progress, certifications, recordings and transcripts, and other activity in the Service, depending on their role and the Customer’s configuration. Content shared by link may be viewable by anyone who has the link.

7. How We Share Information

We share personal information only as follows:

  • With the Customer that provides your access, as described above.
  • With service providers that act on our behalf, such as cloud hosting, databases, storage, AI model providers, email and messaging delivery, analytics, error monitoring, customer support, and payment processing, bound by contractual confidentiality and data-protection obligations.
  • With integrations a Customer or User chooses to connect.
  • For legal reasons, when we believe in good faith that disclosure is needed to comply with law or legal process, to respond to lawful requests from public authorities, or to protect the rights, property, or safety of Eightball, our users, or others.
  • In a business transfer, such as a merger, acquisition, financing, reorganization, or sale of assets, subject to standard confidentiality protections.
  • With consent or at the direction of the Customer or User.
  • In aggregated or de-identified form that does not reasonably identify any individual or Customer.

8. Data Retention

We keep Customer Data for as long as the Customer’s account is active or as the Customer instructs, and then delete or de-identify it within a reasonable period after the account ends, as described in the Terms of Service. We keep other personal information for as long as needed for the purposes described in this policy, including to meet legal, accounting, security, and dispute-resolution needs. Copies in backups are deleted on our normal backup cycle.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please contact support@eightball.ai if you believe your account has been compromised.

10. Cookies and Analytics

We use cookies, local storage, and similar technologies that are needed to sign you in, keep your session secure, and remember preferences, and analytics tools to understand how the Service is used and to diagnose problems. We do not use advertising cookies in the Service. You can control cookies through your browser settings, but blocking essential cookies will prevent you from signing in. The Service does not respond to browser “Do Not Track” signals.

11. International Transfers

We are based in the United States, and we and our service providers may process personal information in the United States and other countries whose data protection laws may differ from those where you live. Where required, we rely on appropriate safeguards for these transfers, such as the European Commission’s Standard Contractual Clauses and the UK equivalent.

12. Your Rights and Choices

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, to withdraw consent, and to complain to a data protection authority. California residents have rights under the CCPA, as amended, and we will not discriminate against anyone for exercising them.

For Customer Data, please send your request to the organization that gave you access; we will help that organization respond. For other personal information, contact privacy@eightball.ai. We may need to verify your identity before acting on a request, and we may decline requests where the law allows. You can opt out of marketing email at any time with the unsubscribe link in the message; service messages will continue while you use the Service.

13. Children

The Service is intended for adults at least eighteen (18) years old and is not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy with a new “Last updated” date and, for material changes, give reasonable notice by email or in the Service.
